Question:

I am the primary custodian already and I now want to take away my daughters mothers rights away completly. She has never paid any childsupport in over 2 years and rarly ever calls and hardly ever sees her do I stand a chance of doing this.

Answer:

First let me say I am not licensed in Missouri. You should also contact an attorney in your state as the law will vary from state to state. If the mother's rights are terminated, her obligation to pay support will also terminate. This may not matter if she is failing to pay anyway. Most states will not terminate parental rights unless someone else is taking that parents place. This is usually accomplished through an adoption. If you are remarried and your wife wants to adopt then you may be able to terminate the mother's rights this way. Every state will have certain requirements to terminate rights involuntarily. There is usually a pretty high standard to do so. Check with an attorney in your area to determine the likelihood of an involuntary termination.
