Ask a Lawyer: arrears owed

Question:

I received a letter from Social Security Disability telling me that NYC Child Support Enforcement directed them to garnish $537.40 a month for arrears owed. I have been disabled for many years and my monthly check is only $827.00. After paying my rent and my doctor's bills I have nothing left. I also have a garnishment against me from NYS Education Dept because again I couldn't afford to pay them back. I am raising my 9 year old son on my own. How am I supposed to live? I cannot go to NYC because of my disability. I current live in Northampton County, Pennsylvania.

Answer:

I am not licensed in NY. I suggest you contact the enforcement agency and see if the order can be modified. They may be garnishing a higher amount than allowed. Also contact a legal aid agency in your area or NY to see if they can give you any advice.
