Ask a Lawyer: Should I pay for sports on top of child support?

Posted by: Dads Divorce

Question:

My ex-wife says she will only enroll my son in sports activities if I pay for half (or more) of the fees. Can you tell me whether sports and other school activities should come out of child support, or if that's extra?

Answer:

Generally extracurricular activities, uninsured medical expenses and educational fees are not included in child support. For example clothing is included in child support payments, but cleats or baseball uniforms would not be included. However, if your decree or parenting plan does not specify that you must pay half (or some other percentage) you are not required to pay the extracurricular expenses, but neither is the mother required to pay for all of the expense.
