Question: My ex-wife was awarded our home in the divorce papers. The children are gone and she was given 6 months to either refinance it or put it up for sale. The divorce was final on March 27 2007 and she was approved for a new morgage twice within the time frame, but in both cases refused to sign. She finaly put it up for sale at a much inflated price. The price used during the dirvorce was 170,000 she is now asking 220,000. I have just been diagnosed with Hodgkins Lymophoma and my new wife and I want to sell our house and purchase a Condo because of my illness to cut down on maintenance.

We are worried that with my name still on the old morgage we may not be able to get a loan. What are my options?

Answer: I am not licensed in Michigan. You should consult an attorney your state. The answer to your question will likely be found in your divorce papers. If she did not comply with the provisions regarding the refinance, then you may be able to compel said compliance or have her found in contempt. If the wording of the Decree gave her options regarding sale, then she may not be in contempt.

You may want to get an order regarding sales price and reduction of the price if it does not sell within certain time period. This may help speed up the process.
