How do I file for divorce if my wife cannot be located?

Question: I have been married for three years, but separated for two and I have full custody of my son who I have had since he was two months old. I don't know where my wife is but I want to get on with my life. So what I need to know from you is how do I get a divorce if I don't know where she is.

Answer: Jurisdictions differ on how to acquire personal service upon the Respondent. Generally, some attempt needs to be made to serve your Wife at her last known address. If that fails you can attempt to have her served by publication. If service by publication is allowed in your jurisdiciton you would need to request approval from the court and then put a statement in the legal newspaper in your area that you are seeking a divorce. If the publication is not allowed in your jurisdiction I suggest that you hire a private investigator to locate your wife and then have her served.
