Can I prevent my ex from moving with my child?

Question: What can I do to keep my ex from moving my child out of Missouri? What statute prevents her from doing this?

Answer: Many states (including Missouri - Section 452.377) have a law that requires a custodial parent to give written notice of a proposed change of residence for a minor child to the other parent, who may request a hearing if he objects to the change of residence of the minor child. Missouri also has a law (Section 452.411) that states if either parent of a child changes his residence to another state, such change of residence of the parent shall be deemed a change of circumstances, allowing the court to modify a prior visitation or custody decree.
