Misdirected Support
Question: My live-in boyfriend of 7 months is married but separated and has two children. One child lives with us and the other who has been living with her mother in a homeless shelter. Just recently we took in the daughter who was living with her mother in the shelter because the mother was kicked out of the 4th shelter because she could not follow the rules of the home. The mother is on welfare and getting assistance for two children she does not have as well as getting child support for the two children that live under our roof.
My question to you is what are his rights as a father to get child support stopped due to the fact he has had one of the children all along and now the second child.

Answer: The parent who has primary care of the children should receive child support (or at least not pay it). You need to file a Motion to Modify of the court order (that orders child support) based upon the changed circumstances that you have told me about.
