Father's Rights

Question: I have 3 children with my ex-husband who has not seen them in at least two years other than brief meetings. He has paid me no more than 400.00 in child support since April 05. We agreed to standard visitation and 100.00 weekly child support when we got divorced in April 05. But now all of a sudden he came into the picture and wants to see the kids and start paying child support. I am wondering just what he is entitled to at this point after all that time has passed. Any info you could offer would be very helpful

Answer: The Court Order has remained in effect even though it has not been exercised. If you want to prevent contact with him and the kids, then you need to file a motion to modify the court order based upon his lack of contact/bond with kids or that he is a danger to them. Essentially the court can only change the visitation if it is in the best interests of the children. He owes all of the back child support though so it must be paid as well.
