Can I kick her out if she's having an affair?

Question: I recently found out my wife was sleeping with another guy and then I found out she had another affair last August which lasted 7 months. We've already filed for a dissolution that is final on the 23rd of Aug. I've tried to be polite about this whole thing for the kids sake (boy-6, girl-4) and she is living here but still seeing him. I also get the house, but her still seeing him is starting to get to me. Is there anything I can do to move her out now or do I have to wait and put up with it until our divorce is final? After the divorce is final what can I do to move her out? Any help would be grateful.

Answer: Generally she can't be removed unless the court orders it. Therefore under the situation you describe, I think you have to wait until the divorce is finished and the court awards the house to you. Once it is your property, obviously you can remove her.
