New Spouse's Business Income
Question: My new wife has been a photographer as a second income for years before she met me. Since we have been togehter, I have tried to help her increase the business with the goal of her doing the photography full-time. I get no 1099 from the business, I get no W-2. The EIN number for the business is connected directly to her social security number only. My ex-wife now wants to claim the money from my wife's business can be used for child support. Can it be counted and is there anything else I can do to protoect my wife's hard work?
Answer: Most likely the court will not include your new wife's income unless you are not earning at the capacity you are capable of or not working full time because of helping your wife's business. Generally that is the only time that the court will find it is relevant!
