Stopping Garnishment?

Question: I'm divorced from my wife and in the divorce she retained the truck and payments for it. She isn't making the payments and not getting it under her name like she was supposed to. The bank is attempting to come after me because apparently my name is still attatched. What can I do and why isn't the bank going after her and not me?

Answer: I am not licensed in Kansas you should also consult an attorney in your state. You cannot prevent the bank from coming after you for the money. Since your ex failed to refinance the loan and have your name removed, you are still obligated to the bank. Your remedy is through the divorce court. Your ex has failed to comply with the court's order. You can asked that she be found in contempt and be ordered to repay you for any damages incurred for her failure to pay the truck payment.
