I Want Custody

Question: I am a 26 year old male who wants custody of my 4 month old. I was not married to his mother but she tries to dictate everything about my child and doesn't let me see my child half the time. She used to party a lot, I dont know if she does drugs but she was crazy in our relationship. What can/should I do? I want to look good and earn full custody. What will the courts be looking for in determining this?

Answer: First, I must let you know I am not licensed in Maryland. All states will have varying laws pertaining to custody. You should also consult an attorney in your state.

Since you were not married at the time your child was born your first step is to establish paternity. It is usually necessary to do this through the court. By doing so you establish your parental rights and obligations. If there is any question that you are the father of this child, this is the time to address that issue. The court can order a DNA test prior to establishing paternity.

Once paternity is established the issues of custody, parenting time and support will be entered. Custody is usually based on the best interest of the child. You will need to show the court that it is in the child's best interest to be with you. It is important to file paternity/custody sooner rather than later. Consult an attorney in your area to determine the accepted procedure for doing so.
