My wife does not have insurance and a week after I filed for divorce she incurred several large medical bills.

What, if any, responsibility will I have regarding the forthcoming medical bills if we were separated at the time these costs were levied?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Nebraska and Iowa divorce laws where I am licensed to practice.

Typically, debts incurred during the marriage are debts of both spouses and debts of the marriage. However, where I practice, once a party files, the filing date is typically the "cut off" date. 

That being said, the debts incurred by the parties after the date of filing more often than not become the debt of the party who incurred the debt.

In the event you are contacted by the medical providers, then you should explain you have filed for divorce and they will need to contact your divorce attorney.

Remember, I am unable to provide you with anything more than divorce tips for men, so please consult with a divorce lawyer in your jurisdiction.
