oklahoma city divorce lawyerQuestion:

During the divorce process, there was an Automatic Temporary Injunction that barred either party from changing the life insurance policy beneficiary.

My wife died shortly before our divorce was finalized, and I discovered she changed beneficiaries on her life policies even while under the temporary order.

Does the Automatic Temporary Injunction hold any weight if it is violated?

Answer:

I am unable to give you legal advice on divorce. I can give general divorce help for men, though, my knowledge is based on Oklahoma divorce laws where I am licensed to practice.

The Automatic Temporary Injunction is an order of the court. If it is violated, a person can be held in contempt of court for violating the order and sentenced accordingly.

The Automatic Temporary Injunction has the same weight as any other court order.

The Automatic Temporary Injunction barred your wife from changing the insurance policy but was not an order against the insurance company or any third party. The change in the life insurance policy could be invalid because of the court order that indicates that it cannot be done.

Remember, I am unable to provide you with anything more than divorce tips for men, so please consult with a divorce lawyer in your jurisdiction.
