The answer to your question will most likely be determined by the classification of the monthly payments. Generally speaking, each state will have its own laws on alimony, also known as maintenance or spousal support.

Where I practice, alimony is tax deductible to the payor and income to the recipient. However, property division payments and child support payments are not tax deductible.

Depending on the laws of your state and the language of your marriage separation agreement, it may be possible to classify your payments as spousal support.
