Question:

property division divorceMy state is an "equitable distribution" state with regard to division of assets and debts. So how does equitable distribution work?

In my example, I make significantly more than my wife because she has chosen to work a low-paying, part-time job after quitting a full-time job that paid much more money.

This proves her ability to earn more.

Will the court consider her voluntary underemployment in dividing property?

mens divorce lawyer William BackerQuestion:

I recently lost my job and now only receive unemployment benefits. I have filed for a child support and maintenance modification since I have no money but the court date is set for 6 months from now!

Can I suspend my alimony and child support payments in the meantime until I find a job with more income?

divorce attorney Jill DuffyQuestion:

My ex-wife has is remarried to a very wealthy new spouse so she has decided to stop working. I pay child support to her, which she is wanting to substantially increase despite her being financially well off.

I understand that her income from work can be imputed for child support calculations. What else can be considered as income? Does the fact that her new husband completely supports her play a factor?

Question:

My husband is paying a higher child support amount then he should be due to his unemployment. Child support was based on his past income and not his current income.

We have filed a motion to modify child support, but the hearing is consistently being continued and pushed back to later dates.

How can we get this hearing heard before we bankrupt ourselves paying a child support amount that is unreasonable given our current income?
