My question is about taxes and claiming dependents if we were divorced less than a year ago.

Our divorce agreement states that each of us would claim one child as a dependent until they are 18, though nothing specifically mentions how to handle 2012, the year we were divorced. 

I've mentioned doing "married filing jointly" to her recently and she didn't agree to it.

Can I legally claim them all as dependents for 2012 regardless of whether she agrees even if she files separately?

This is a tax question related to the 2013 Dependent Care Flexible Spending Account and claiming the child as a dependent.

I share joint custody with my ex-wife, but she will be claiming our son as a dependent for 2013 taxes. I am considering a Flexible Spending Account for Dependent Care (daycare) and want to know if I can do this next year since she will be claiming our son as dependent on her taxes.

Will my ex-wife's child tax credit interfere with my use of a Dependent Care Flexible Spending Account?

Our divorce decree states that I can claim our children for tax purposes even though I am the noncustodial parent and my ex-wife is the custodial parent.

Now my ex-wife wants to claim one or both of our children on her taxes because she no longer thinks it's fair that the noncustodial parent is receiving the dependent exemption.

What will happen if she violates the decree and claims our children on her taxes?

How do child support calculations count one-time relocation payments?

I moved as a requirement of my employment and received a tax neutral relocation payment to offset losses on the house I sold, moving, and purchasing expenses.

Can my ex-wife go after that money next year when it shows up on my W-2 as wages for this year? My problem is that it was a one-time payment and my wages have not increased.

My property division question is about how my IRA account will be divided.

We have agreed to splitting the amount with my receiving 100% of the value of the IRA at the time of our marriage and then splitting the contributions and earnings of the IRA after our marriage 50/50.

How do we word the judgment in order to accept these conditions to create two separate accounts without either of us incurring any tax liability on the division of the original account?
