Question:

The mother of my daughter says they are going to Disneyland and it will cut into my visitation on Father's Day.  Is she allowed to do this?  What can I do before that day to stop this?  If I wait to resolve this later, she'll just take her without regard?

Question:

My wife and I have kept everything financial separated throughout our 2-year marriage. Now, facing divorce, I am wondering how things will be divided. We have no joint accounts of any kind, checking, savings, credit cards, cell phone plan, etc. I have savings (checking, savings, 401K, IRA, stocks, house). She has zero savings and is in debt (acquired prior to marriage). Her credit card debt is close to $2000, and she has a loan against her 401K. She has no other assets except her car and jewelry.

The house is in my name, and I was living in it prior to our marriage. I have 20% equity in house. My wife has never made any payments towards house. Does she have any right to the equity in the house?

I’d also like to know if she has any right to half of my 401K. We were married in 2008, and the value of my 401K is now less than what is was when we married. Does she have rights to half of the gains made in 2009, but none of the losses in 2008? And does the same apply for IRA's?

Question:

I've been divorced for over a year now and have been paying child support every month without fail. Now, the state of Mississippi is telling me that the federal law says I must pay my support through them because my ex-wife is receiving food stamps. I provided the state proof that I am current on my support payments only to receive a call from the Human Resources department at my office a month later.  HR is now telling me that they received an order of garnishment from the state of Mississippi. I called the state and again they told me it's a federal law that if I have a job, support must be taken from my paycheck. It's an embarrassment at work and I feel it is all because my wife refuses to work. How do you recommend I handle this?

Question:

My wife and I are thinking very seriously about getting a divorce. We've been married for almost three years and have a daughter of twenty-two months. We currently live in New York City, and she has been unemployed since May 2008. She keeps saying that she can't find a job.

Her family lives in Texas, but she doesn't want to go there because I won't be able to see my daughter. Our current rent is $2000 a month and I wanted to know what will happen if we separate. Do I have to pay for her rent and bills plus child support?  My salary is not that large, and there is no way I can afford all of these expenses.
