Question:

My common law wife has told me that she wants to move on for the third time in 5 years. I want to make it work, but this time I think she is having an affair and don't think I can do it anymore.

I put her through college, we own two homes, have one son together, and I have raised her other son for 12 years. I desperately want to keep this house to raise our boys in, but I can't afford it on my own. She has said that I can have both kids. She inherited 120 acres of farmland in Minnesota that is split betwen her and her older brother. Would I be entitled to 1/2 of her share? If so, I think I could keep the house and the boys.  This would enable me to potentially begin moving forward.

Question:

My wife and I are about to file for a divorce, but I would also like to file for joint legal and physical custody. My wife has stated that I am abusive, but I'm not. There has never been a police report filed, but she says she will state this anyway. I'm a great father, having always supported my kids emotionally and financially.

My question is: Can her accusations prevent me from getting joint custody?  Also, since she has two DUI’s within the last 12 years, and as a result a suspended license on her record, will this help my case? How should I go about preparing to bring up her history if I need to?

Question:

How can I negotiate my debt owed to my divorce attorney? When my divorced was finalized, I was left with a huge bill owed to my lawyer. I'm currently unemployed and have asked my divorce attorney to accept a lesser amount in an effort to satisfy my debt to him. Do you have any advice on how to negotiate?

Question:

I have recently separated from my wife. She is staying at the family home for now, and we have basically agreed on child support, and the distribution of certain belongings.

What would be your advice on how I should proceed with this situation legally in order to better protect myself. There is nothing in writing up to now, and no attorneys are involved. I want as much time with the kids as possible and don't want to be overburdened with maintenance.  What are the benefits/dangers of filing for divorce and taking the initiative to move this along?
