Do child support laws allow modifications to be made retroactive?

About 6 months ago, I sustained a 20% salary reduction, but I did not file a petition to modify child support until recently.

If the judge grants the decrease in child support, would it be made retroactive to the time my salary decreased or to when the child support modification was actually filed?

My legal separation advice question is about child support laws when requesting retroactive child support during the pendency of divorce.

My wife left me six months ago. In her filing for divorce, she requested I pay her retroactive child support starting from the moment she moved out of the marital home.

Will she be awarded retroactive child support payments from the time she left me until the divorce is finalized?

I was recently ordered to pay child support at a percentage rate of 20% of my earnings, which I have no problem with.

But at the closing of the hearing, the judge decided to apply retroactive child support and add it to the original amount which would increase my weekly payment to 26%. Is this legal?

  • How will a judge calculate your child support obligation for purposes of a modification? Can a child support modification be made retroactive to the date you filed the modification paperwork? Will having an attorney appear on your behalf eliminate the need for you to appear in person?
