Question:

I have been paying back child support to Jefferson County Department of Child Support Services in Birmingham, Alabama for about seven or eight years. The principle on the judgement is approximately $7,000 however, the interest is over $20,000. This amount is showing up on my credit report as if I owe $30,000 in back child support. Is there something that I can do to change the interest rate or alleviate it all together? I pay $500 a month and have done so for many years however, it seems like the debt never decreases.

Answer:

Allow me to preface my response with the disclaimer that I am not licensed in the State of Alabama. In most states the interest is statutory, meaning provided for in the law so you will prabably not be able to change or elimiate it. However, contact the child support department and ask for a history fo payments and interest. You should be able to verify that all of the payments are being applied and see the progress of the payoff.

Question:

Can a noncustodial parent ask the child's school to forward a copy of the child's report card to them? Do they need some type of court order? Our agreement dosen't mention any thing about the child's report card and I keep being told they'll forward one but they never do. I want to know if there's a law that allows me to request the copies to be sent to me or what my rights are.

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of New York. Usually your court order states that you are entitled to such things. If it does, provide a copy to the school. If it does not then I would suggest speaking directly to the administrator at the school responsible for the report cards. In my jurisdiction, I am not aware of a law that entitles you to this, but usually a court order stating you are a legal parent is enough.
