St. Louis divorce lawyerQuestion:

Do child custody laws allow a person to include a relocation consent clause in the divorce decree?

I want to include a provision in our child custody agreement preventing my wife from moving our children more than X miles away from me without my prior consent. She is refusing to agree to this relocation clause, though.

What are my options? Isn't this a pretty standard child custody provision?

moving children divorce

The combination of a struggling economy and increased housing debt is leading to an increase in child custody cases involving relocation requests from custodial parents who find it necessary to move, according to a new survey.

The main reasons for these relocation petitions have been to pursue other job opportunities or to be with a new partner, according to the report from the American Academy of Matrimonial Lawyers (AAML).

Question:Kevin Mammola Atlanta Divorce Attorney

My ex-wife has primary child custody of our children and she just filed an intent to relocate motion.

She sent it to me via regular mail and to the wrong address, but I still ended up receiving it anyways.

Aren't these type of motions or documents supposed to be served to me via certified mail?

Question:Kevin Mammola Atlanta Divorce Attorney

What are the child custody laws regarding keeping the custodial parent from moving with the children?

My ex-wife wants to move with our children to live with her friends who live more than 100 miles away. I do not agree with her choice and believe it will put our children at risk.

Can I file a Motion to Prevent Relocation to keep her from moving?

Do I have to to file for temporary custody on top of the Motion to Prevent Relocation?

I share joint legal custody of my daughter with my ex-wife who is moving away to another school district.

Is she allowed to relocate to another school district and enroll our child in another school without my permission?
