You survive the first divorce with about half of what you previously owned and swear you will never get married again. Then a few years go by and you’ve met another woman and have overcome the bitter taste of your last divorce.

Your heart is swept away and you have decided to get married again, but you are smarter now and will get your new spouse to sign a pre-nuptial (or ante-nuptial) agreement. Let’s assume both of you hire attorneys and both of you sign the agreement right before you are married.

Remember, your pre-nuptial agreement is only as good as your compliance with it. There are also other considerations to be aware of if you want it to be enforceable.

Divorce attorney Jason BowmanQuestion:

My wife and I are almost in the final stages of our divorce that has been going on for over a year. I assume I will have to pay for some of the debts of the marriage.

But will the distributed debt include the credit card debt she brought into the marriage and the debt she has since gotten into after we separated but before the divorce is finalized?

She has an attorney and I am doing the divorce pro se so I want to make sure this is addressed properly.

Question:Cordell & Cordell attorney Andrea Miller

My question is about dividing marital property as it relates to the marital home.

My wife and I bought a house before we were married. Am I entitled to the money I spent remodeling the home since we weren’t married at the time?

Also, since I’m going at this pro se what language should I use? Should I just say I would like reimbursed for the money spent on remodeling prior to getting married?

Question:

I have watched as the court is allowing evidence in a case. This evidence is 18 years old and the marriage was only 8 years old. How the ex obtained this evidence is not being allowed to be contested in court. Not to mention how old the information is. Please tell me how your law firm thinks about this kind of disclosure in our law system. How would you try and resolve this situation. I want to know if your law firm would even try to come up with a way to block it.

Answer:

It really depends upon what the evidence and situation. I really do not see how 18 year old evidence would be relevant in most circumstances. I had something like this come up some years past and file a Motion in Lemine which is a pre-trial motion that sets rules for the trial. In that Motion, the Wife wanted to bring forth some testimony concerning the father from 15 years past when he was 14 years old. I filed and won the motion and the opposing party was prevented from offering evidence or testimony about the issue. If the matter is already at trial, the attorney should object. If extremely important, the attorney could ask for the proceedings to be halted while he files a Writ with the Court of Appeals. If the information was allowed over objection and a Writ was not filed you could appeal the issue if the judgment is less than 40 days old.
