I'm looking for financial advice on divorce on child support laws.

I recently took a job with a higher paying salary that my ex-wife does not know about. I already pay her child support, alimony, child care costs, etc., and the increased income is not very substantial.

Do I have to voluntarily notify her and disclose my increased salary?

I was recently ordered to pay child support at a percentage rate of 20% of my earnings, which I have no problem with.

But at the closing of the hearing, the judge decided to apply retroactive child support and add it to the original amount which would increase my weekly payment to 26%. Is this legal?

Question:

I have been divorced over 5 years. I pay no child support. I have joint legal and joint physical custody of my son. We get along fine and trade days, weeks, eves, etc. with absolutely no problems. Recently, my ex has become very serious about changing jobs. Because of her career, there is about a 90% likelihood she will take about a 10-15k a year pay cut. I asked her how she will be able to afford that type of pay cut? She will only say that she doesn't need that much money to make it. I am concerned that she is going to go after a modification and now ask for child support. I have kept my end of the bargain, my son lives with me 1/2 the time and we split all expenses 50/50. We originally made about the same money. Now I have a disibility retirement pension plus I've started my own company. I may make about 10k more than she does presently, including my retirement. Do I have anything to worry about? Am I being too paranoid? When I had to suddenly take a disability retirement I never asked her for money when she made more than me. Any suggestions? Thanks in advance!!

Answer:

If she does file and takes a voluntary pay cut then the court most likely will not look on that as just cause to modify the support arrangement alone. Even with your increase, you should still be successful in fending off a request for child support unless there are other factors plead by her, and not known to you now.

Question:

My husband will be retiring soon from the Air Force and his ex wants, and according to the Air Force, is entitled to half his retirement pay. She ran out on him and left him with 4 kids and all of the bills while she was off doing "her own thing". Have you heard of anyone challenging the military on the automatic payment of 50% of retirement to the ex spouse. I understand why it was originally writte; to protect wives that were run out on, but she did it to him! It just seems so wrong !!!

Answer:

He will need to check with the Air Force regarding his specific plan. Does it state she is entitled as the ex-wife? What about the divorce decree? These are very factually specific. Please check these documents and speak to an attorney to see if you have any remedies. However, if she was allocated some benefits in the divorce then you most likely will not be able to challenge it.
