Noblesville Indiana Divorce LawyerQuestion:

It has just come to my attention that I have overpaid my child support payments due to an incorrect wage garnishment of my military pay above the court-ordered amount.

I filed the request months ago to stop my military wage garnishments and was told they would stop. I later found out the person helping me at the child support division failed to file the necessary paperwork resulting in the overpayments.

How can I get this child support situation rectified and receive credit for the overpayments already made because of the child support office's error?

oklahoma city divorce lawyerQuestion:

I have been paying child support for my oldest son who reached the age of emancipation three years ago because the child support modification papers were never filed with the court.

Now my youngest child has reached the age of majority as well, and I want to ensure these child support payments stop.

Can child support be modified retroactively to when my oldest child reached the age of emancipation?

child supportQuestion:

How do child support laws handle the wage garnishment termination for past due child support?

I have paid off my child support arrears in whole. Yet, I continue to have money taken out of my paycheck via wage garnishment to the point that now I have overpaid my child support obligation by several thousand dollars.

How can I cease the wage garnishment and collect the overpaid child support?

oklahoma city divorce lawyerChild Support Laws Question:

In the judgment terminating my child support payments, my ex-wife was ordered to pay for my "reasonable attorney fees" and a default order was entered "reserving" the issue of my child support overpayments.

What does "reserving" the issue of overpayment mean, and how do I prove the amount overpaid?

Also, what process do I go through to have those attorney costs reimbursed?

men's divorce lawyer Rachel BrucksQuestion:

I was recently notified that I overpaid my child support obligation by $10,000 due to my employer's payroll office reacting slowly to changes in my wage garnishment.

However, I was never notified by my state when this overpayment began and they let it go on for a significant amount of time. There is no accountability and the only suggestion they have given me to be reimbursed for this overpayment of child support is to sue my ex.

Are there any other options available?
