Question:

The mother of my daughter (age 11) currently has sole custody of her. I have visitation every 1st and 3rd weekend of every month and the usual Father's Day, spring break and other items on the court order. My ex tells me not to leave my daughter alone with my current wife or her parents. These are loving people who treat my daughter as their own. My daughter expresses to me that she wants to have "girl time" with my wife and her family. My wife says my ex can't tell me that while I have visitation. I will seek joint phisical/legal custody next year, but I would like my daughter to be able to stay alone with my wife and her family if she wishes to do so. Please help me with this. I don't like seeing my daughter hurt. Thank you in advance for your reply.

Answer:

I am not licensed in Alabama. The law regarding visitation does vary from state to state. Unless your divorce decree or another court order prohibits your wife from being unsupervised around your daughter, you are allowed to leave her alone with your new wife. Your ex cannot control who your daughter spends time with during your visit.
