holiday parenting timeQuestion:

This year my birthday falls on Mother's Day, which is supposed to be my ex-wife's day with our child.

However, I'd like to see my child on my birthday, but she is unwilling to even split time.

Does my birthday or a holiday take precedent when it comes to which parent gets visitation with our child?

Question:

My wife left me and the 5 children, filed for divorce, moved into a studio apartment, bought a small sports car that does not seat enough (5 children).

Now she expects me to move closer to her new life, or she says she will fight me for full custody.

How much weight does the "mother card" carry?

Question:

RE: Divorced - Joint custody of 6 yr old minor girl. Mom has daughter through the school yr and the Dad has daughter during summers and school breaks. Mom remarried a multimillionaire and wants to hyphenate the daughter's last name without the fathers permission. We are not even sure this marriage is going to last. The daughter's school yearbook reflects this newly hyphenated name. The mother is trying to say that not using the hyphenated name is psychologically damaging to the child (she just wants to flaunt the name to match her own last name now). The father is a wonderful man and a very good father to his daughter. What legally can he do to set things straight with the school and the stubborn mother who refuses to keep the surname?

Answer:

I am not licensed in CA and therefore cannot answer your question specifically to the laws of that State. I would suggest that you consult a local attorney about filing a Motion to Modify the legal custody or a Motion for Contempt of the Joint Legal custody arrangment. Changing the child's name is a legal custody issue that should be decided together if the parties share joint legal custody.
