St. Louis divorce lawyerQuestion:

The amount of parenting time I have with my child has drastically decreased since I had to move to another country for my job and now my ex-wife is seeking a child custody modification.

If my ex-wife is successful in modifying the custody order to reflect our new circumstances I’m worried that when I do move back to the U.S. that we would have to abide by a modification issued when I lived out of the country.

Could my ex-wife win a child custody modification because I'm temporarily living overseas?

What are my ex-wife's chances for successfully winning a child custody modification?

She filed a modification of custody because my daughter has been late to school several times this year while in my care and I have a new child on the way with my pregnant wife.

Does the fact that my child was late for school a few times and that I have another baby on the way with my new wife qualify as big enough reasons to change our custody arrangement?

Is this not unethical for attorneys to advise a client about a case involving children in front of the children?

And what are the chances of someone successfully winning a child custody modification case?

Indiana Divorce LawyerQuestion:

My parenting time question deals with the amount of travel I am doing for child custody exchanges.

My divorce decree does not address transportation and who travels how far when exchanging the children. My children live far from me, but I still make the long drive every weekend to see them.

This significantly cuts into my parenting time - I don't count sitting in the car as quality time - and my travel and gas expenses are enormous while my ex-wife stays put and doesn't pay for anything.

Is there anything I can do to modify the child custody agreement or input language into our divorce decree that discusses how to handle parenting time pick ups and drop offs?

My ex-wife has primary custody of our son, but I would like to know if I can modify the child custody schedule due to his poor grades.

Over the last several years our son has failed the majority of his classes and gotten in trouble at school, including a recent suspension.

Is the fact that he is failing out of school and is routinely in trouble because of his poor behavior enough of a reason to attempt to modify child custody and have him live with me?
