Can I file for a modification of child custody if I am in arrears for child support?

My ex-wife has lost her job and her home, and now her and my daughter are living at a friend's house.

I believe our child would have a more stable environment living with me, but I need to know my chances of gaining custody if I have these child support problems.

I would like to modify our child custody agreements so that our children can travel alone to come see me.

When we divorced, our children were young and I agreed to pay all travel expenses so they could fly to visit me in another state. The order required us to have an adult accompany the children when they flew, which I also had to pay for.

Now that the children are old enough to fly as unaccompanied minors I would like for them to do so, but my ex is refusing.

Is it reasonable to try and modify my child custody orders to allow the children to fly as unaccompanied minors?

Question:Divorce lawyer Leslie Lorenzano

My ex-wife and I mutually agreed to change custody of our child and he now lives with me so I am the custodial parent. However, I still have child support deducted out of my paychecks and sent to her because we have not officially made this change with the court.

I would like the court to recognize our new custodial arrangement and the fact that I waive my right to needing child support from her.

What kind of legal documents to I have to give the court to have them recognize this and does an attorney need to be involved if we have a mutual agreement?

My question is in reference to who has priority over custody when a third party is involved with parenting time pickups and dropoffs. 

For example, we normally go through a custody exchange at daycare (I drop the child off in the morning and the mother picks up the child after work).

If I were to take the day off from work, does my ex-wife have the right to have her boyfriend pick the child up at my house in the morning or does my right as a father allow me to spend the time with my child until his mother can actually fulfill her custodial role?

My child support payments were calculated at me only having my kids with me for one day a week. But my ex-wife's travel schedule means I have the kids for at least 50% of the days each month.

Can I go back to court and have my child support modified based on the new parenting schedule?
