marital homeBy Nathan A. Hacker

Indianapolis Divorce Lawyer

What do you do with the marital home when you’re getting divorced?

There a few options and some things you should be aware of before you sign off on any agreement with your wife.

The following is a list of 5 tips to consider when dividing your marital home during a divorce:

marital home valueQuestion:

I was awarded the marital home in the divorce that is currently worth less than what we purchased it for.

My divorce decree states that I need to refinance or sell the home or I owe my ex an additional sum of money.

I am unable to sell or refinance because the home is so upside down, and if I foreclose on the property, my ex-wife says she will sue me for ruining her credit score.

What options are available to me for dealing with the marital home?

St. Louis divorce lawyerQuestion:

My divorce property division was one-sided to my ex-wife and I want to know how to appeal.

I was ordered to pay half of her credit card debt, which was accumulated before we were married. She lied to the judge and said they were marital debts.

Even though the final order states that neither party was credible on the issue of the credit card debt I was ordered to contribute to her monthly payments.

I have objected and appealed, but it was denied. How is this legal?

divorce lawyer Daniel ExnerQuestion:

I need financial advice on divorce on how to protect my assets and 401k.

I think we are heading to divorce, and I assume I am going to need all the extra money I can to afford the best divorce lawyer. I was considering stopping my contributions to my 401k for the time being.

Should I stop putting money in my 401(k) account in order to free up additional cash and to keep my wife from getting an even larger share of my retirement account?

advice on divorceQuestion:

Do you have any financial advice on divorce when it comes to dividing retirement and mutual funds?

My wife and I have reached a proposed agreement to divide the retirement accounts and that each of us will retain any stock, bond, or mutual fund that is held in one person's name solely.

Can our proposed financial settlement overrule any state laws that require us to divide all the property we acquired during the marriage?
