divorce jurisdictionBy Sara Pitcher

Noblesville, Indiana Divorce Lawyer

If divorcing parties physically separate and move to different counties, or even different states before legally separating, this can raise questions as to where to where the jurisdiction is in order to file for the dissolution of the marriage or the legal separation.

In order to determine which is the proper court in which to bring your action for dissolution or legal separation, you must look at which court would have jurisdiction over the action and over the parties involved.

domestic violence mythsBy Julie Garrison

Special to DadsDivorce.com

It is uninformed attitudes like the ones discussed in my previous divorce article that have pigeonholed domestic violence as a women's issue only and ignores mens rights.

Research shows women in their 20s and 30s are statistically more likely to commit violence against men than their mothers did.

One of the reasons for this demographical age difference is that younger women have learned from their mothers, teachers, other mentors and role models that men are the abusers and women are (always) the victims.

They have also been taught that men can cause physical injury and – absent a weapon – women can't because they are physically smaller and weaker. Cultural norms are more tolerant of assaults by women on their partners.

But, how many shelters for battered men have you heard about or seen? Most would say none.

The Florida State University Law Review had this to say about women and domestic violence:

divorce lawyer Daniel ExnerQuestion:

I'm looking for separation advice for men on how to handle the property division of a car I bought my wife.

I bought her a car as a gift prior to our separation, even though she already had a good, reliable car. The car is in my name, but she says I cannot divest the asset because it was "gifted" to her.

If the vehicle I purchased is considered a "gift" is it her separate property or is it marital property subject to division?

shared parenting Jim KastamaAll children need two parents in their lives even if their parents are divorced.

This concept of the importance of shared parenting is not lost on Washington State Sen. Jim Kastama, who is known as the Washington Legislature's leading advocate for shared parenting and recently announced he is running for Washington's Secretary of State.

Sen. Kastama was recently invited on stage at a Blue October concert in Seattle drumming up support within the crowd to allow divorced dads more access to their children.

He visited with DadsDivorce.com editor Matt Allen to discuss the "appalling" statistics of the lack of shared parenting and why it's imperative the younger generation fight for fathers rights.

child alimonyMassachusetts is the latest state to enact sweeping changes to its archaic alimony laws, as alimony reform movements are gaining momentum around the country.

Both houses of the Massachusetts legislature unanimously voted to change the alimony laws, which put an end to lifetime alimony obligations and a cap on payments based on the duration of a marriage.

One of the forces behind the alimony reform movement is Elizabeth Benedict, a novelist and journalist whose op-ed piece in the Boston Globe in 2008 helped moved forward the alimony reform movement in Massachusetts.

Benedict talked with DadsDivorce.com editor Matt Allen about "medieval" alimony laws and what other states are in desperate need of reform. (Note: you can learn more about alimony reform movements in various states by visiting the sites MassAlimonyReform.org and FloridaAlimonyReform.com.)
