I would like to know my options for modifying my divorce decree or setting aside the divorce judgment due to my wife's quick remarriage.

In our divorce agreement, I agreed to pay an amount of support as a "gift" above the monthly child support payments. However, my ex-wife has remarried literally months after our divorce was finalized so she no longer needs this extra financial help.

Can I modify the divorce decree or have that clause removed since our divorce was just recently granted?

Question:Colorado Divorce Attorney

My question deals with child support and paternity laws.

I recently was informed that there was a strong possibility that an ex-girlfriend from many years ago is claiming I am the father of her child.

I've been told it's possible a default judgment was entered against me ruling me as the child's father and setting child support, which I have never paid since I was never served nor informed of this ruling.

What I would like to know is whether I have a warrant against me for unpaid child support, and if so, will they keep me in jail?

child support questionQuestion:

My father still owed my mother tens of thousands in child support when my mother died last year. 

Since she passed away she never got to collect the entire amount owed her.

Even though I am an adult with my own family, do I have a right to those payments owed or does he get off the hook because my mother is now deceased?

In my child support review, the percentages on the child support worksheet indicate I should be paying 70% of child care costs while my wife covers 30%.

However, my divorce decree says we should split child care costs "equally" in the event my ex-wife needs to use child care, which she is indicating she may have to if she gets a full-time job.

Will child care be included in the worksheet to determine child support guidelines? If so, should the judge abide by our agreement and leave the child care off the worksheet or is there a chance the judge may disregard our previous agreement?
