Houston Divorce LawyerQuestion:

We share joint physical custody almost 50/50, but my ex is listed as the primary custodial parent simply because she works from home.

Because she is listed as the primary parent, I am obligated to pay child support yet the child support calculations did not account for her salary. Is this correct?

Also, if we are splitting parenting time why is it that I am obligated to pay child support simply because of a technicality that we had to list one parent as "primary"?

I need to know how to prepare myself for a potential child custody battle. The mother of my child is very promiscuous and often engages in sexual acts while our small child is in the same room.

Apparently this is not illegal, but she continues to behave this way even after I've expressed to her that I think it's highly inappropriate for our child to be anywhere near that.

Is this something that I should be documenting or record our conversations about the subject in case I need it for a possible custody battle?

My ex-wife and I have joint legal and physical custody. However, our daughter has been living with her aunt for the past several years because her behavior was out of control when living with us.

My ex now wants her to come back and live with her, but my daughter is thriving in her new environment and doesn't want to move back home.

My question is at what age does my daughter have the right to decide where she wants to live?
