Question:

My husband and I have recently moved about 3 hours from my step son. We have asked his mother numerous times if she would agree to meet us half way and she refuses. She has a dependable car and my husband pays about $563 a month for child support. Is it fair that she meets us or are we asking the courts for too much? How can we influence the judge to make a fair decision and order her to meet us half way?

Answer:

I am not licensed in California. If there is no court order currently in place requiring her to meet half way then she is within her right to refuse to do so. However, if asked the court will likely order a meeting half way. The court will likely consider the reason for the move and any financial strain it will put on either party. Also considered is the best travel arrangements for the child.
