Ask a Divorce Lawyer: Can the father get custody if the grandparents were given temporary guardianship?

Question:

If temporary guardianship was given to the grandparents because the mother is unable to care for the child, can the father get custody? 

Paternity has been established. The father wasn’t told he had said child until the kid was 4 years old, but the father has been in the child’s life for over 4 years now.

Ask A Laywer: Is This Considered A Conflict of Interest?

Question:

My ex wife works for an attorney and has lots of connections. Our children had a law guardian appointed. I recently discovered that the LG's brother is being represented by my wife's boss in a fraud case. This now explains why the LG blindly supported my wife at every turn to the point where it was obscenely suspicious. The examples I can give would shock you and leave you suspicious.

Is this a conflict of interest that should have been disclosed from the very beginning?

I believe I have a strong case that shows extreme bias and prejudice. What can I do?

Ask a Lawyer: Can custody be changed to the mother-in-law based on substance abuse?

My ex and I have joint legal custody with her having residential and me with liberal visitations. I would like to get residential custody changed to my ex mother-in-law who has legal custody of her other child.The ex has a problem drinking, has had DUIs, the boyfriend just got out of jail for drugs and back child support. Is there anything I can do?

Answer:

I cannot answer your question specifically to the laws of Pennsylvania as I am not licensed to practice law in that State. I think you are talking about what some jurisdictions call a guardianship. The problem with that is you as the other parent have to say that you are unfit or unwilling to be the residential parent. Are you? Have you considered seeking a modification for you getting custody? It sounds like a good idea to me.
