Omaha Nebraska Divorce LawyerQuestion:

During my divorce, the economy tanked and my assets in the business were severely diminished even though alimony was based on my income when my business was thriving..

After a few years of unemployment, I finally had to settle for a position that pays half of what I was making. I can no longer pay the original amount of alimony.

Is it possible to get the spousal support reduced or eliminated even if my divorce decree does not indicate what events would trigger an alimony modification?

modify child support arrearsQuestion:

I currently have child support payments garnished from my Social Security checks.

I need to have these arrears modified due to cost of living expenses and how burdensome it has become with such a large amount taken from my income.

New Jersey divorce lawyerQuestion:

I was just served papers to appear in court due to alleged child support arrears.

I have proof for the child support office that they payments they claim I missed were paid directly to my ex-wife before the wage garnishment was implemented.

Would all I have to do is establish proof to the child support enforcement agency that these payments were made? What type of evidence is needed?

divorce lawyer Daniel LambertQuestion:

I have a vehicle financed in my name.

During temporary orders, my soon-to-be-ex-wife was awarded possession of the vehicle until the divorce is final at which point we are to switch cars since I am driving the one in her name that is paid off.

She is saying that since I signed an uncontested divorce she gets to keep my car.

Is this true? I am the one paying off the loan, making insurance payments, etc. Can I take the car back?

Noblesville Indiana Divorce LawyerQuestion:

Due to my ex-wife’s voluntary unemployment and the fact that I was fired, I would like to modify my child support and ask for a temporary deviance to $0 per week until such time when either party makes 20% more than the other.

Our expenses and amount of parenting time are nearly identical and both of us have experienced drastic reductions in income.

Would this situation be one that qualifies for a modification of child support?
