If your ex-wife's new boyfriend is verbally or physically abusing your child and you are concerned for your child's mental and physical safety and wellbeing, most jurisdictions have a process through which you can ask the court to award you emergency custody.

Typically, this process requires that you file a document with the court alleging that your child is in danger describing the situation and your concerns. The court will likely hear your allegations very quickly.

Most states have rules that require a court to hear such cases within a day or two of filing when there is an emergency.

Question: 

I couldn't get an ex parte order against my wife on behalf of my son because she has already filed for divorce. Is there anything I can do to keep her from taking my son from the babysitter while I'm at work?

I am unclear about the difference's between these two terms. Could you please explain the difference and also can it be to ones advantage to seek "order of protection" against one's STBX before they do? Thanks for your time.

Answer:

First let me preface my answer by saying I am not licensed to practice law in Idaho. Every states' laws do vary. An ex parte order is merely any order by the Judge without hearing from both parties. Usually these are only granted in emergency situations and the judge will usually set a hearing for the other party to be heard. Orders of Protection usually prohibit one party from doing certain things to another party. Usually including harrassing, annoying, threatening or having contact with the party. Many orders of protection are granted ex parte. Not all ex parte orders are orders of protection. Determining whether to obtain an order of protection will really be dependent on the law of your state and requirements for obtaining one.
