child custody modificationQuestion:

I am worried about my children's living conditions when they are with my ex-wife, and I would like to know if a child custody modification is justified.

I keep a very clean home and provide a stable environment for my children, which they do not receive when staying with my ex-wife.

How can I get my kids' living conditions inspected and have it officially recorded to present as evidence during a possible child custody modification trial?

child custody reportBy Daniel L. Lambert

Cordell & Cordell Divorce Lawyer

In some states, a Pretrial Report for Child Custody Trial is required by the judge prior to beginning a child custody battle.

What is required in this report? Do you need to provide to each party all documents, evidence, emails, voice messages, or any other key evidentiary documents at the time of the report being due?

The answer to what and when you have to produce evidence will depend on your local rules, the pretrial order, and your state's child custody laws.

social media divorceBy Sara Pitcher

Noblesville, Indiana Divorce Lawyer

In this age, it should be no surprise that technological advances are having impacts on countless areas of life that were, in the past, totally devoid of any involvement with technology.

This holds especially true for family law cases where social media evidence is increasingly being used in court.

The explosion of social networking coupled with the portability and accessibility of technology has caused trouble for many divorcing men and fathers going through divorce and child custody disputes.

Divorce lawyers frequently receive calls or emails from clients stating, "I’ve got some divorce evidence about…"

What many people don’t understand is that there are series of rules that have to be followed in order to put something into evidence. These rules very from state to state, and many times the variations are not in the wording, but rather in the interpretation.

An understanding of these evidentiary rules can help fathers talk to their divorce lawyers and be in a better position to assist their attorney and stay active in the case.

A common example is the statement by a child about what they experienced at the other parent’s house during parenting time. The following is an example of the checklist that is passing through your attorney’s head as you are explaining what you believe to be evidence:

text message divorceBy Jennifer de Lyon Stralka

Missouri Divorce Lawyer

With approximately 2.5 billion text messages being sent back and forth across the United States each day, it is no surprise that text messages are being used as evidence in divorce and child custody cases.

It is important to keep in mind that in family law cases, if the content of the text messages are deemed relevant by the court, they will most likely be admitted into evidence.
