Paternity Law: Paying Child Support For A Non-Biological Child Born During The Marriage

Is there a paternity law that requires a husband to pay child support for a child born during the marriage even if he is not the biological father?

My wife and I are still married, but we are considering a divorce. She recently had a baby that I do not believe is mine because she frequently has cheated on me.

If I were able to get a DNA test proving the child is not mine, would I still have to pay child support since the child was born while we were married?

Ask a Lawyer: Why doesn't she have to pay child support?

Question:

My husband and I live in Michigan. He has custody of his 2 oldest boys and has for the past 5 years or so. He has 3 children in all. My husband has recently applied for child support for the 2 boys. He just received a letter from the court stating that the biological parent has not sent in the financial information needed to continue the case, therefore it has been dropped. My husband had to pay child support for his 3 children in which he even had custody of 1 at the time. He went to jail several times for non-payment. He shouldn't have had to pay for him in the first place. Why is it that she doesn't have to pay for child support for who she doesn't have custody of? Just because she didn't send in the financial info. needed? My husband had to pay for a child that he all along had custody of. If she was to file for child support for the youngest child in which she has custody of I would only hope that my husband would not have to pay only because he didn't send in the financial information.

I cannot answer your question specifically to the laws of MI as I am not licensed in that State. It sounds like you were attempting to establish child support through the Division of Child Support Enforcement or the Michigan equivalent. I suggest you retain an attorney and pursue the child support through the family courts.
