Divorce attorney Jason BowmanQuestion:

I have heard that in my state, only a minimum of a 20% increase in income would warrant a modification of child support. My income has increased, but not by 20%. My ex has filed a hearing to determine if I should pay more child support

I don't want to have to hire an attorney to represent me since I live out of state and can't make this hearing. Can someone other than an attorney show up on my behalf and provide records of my income to prove what I make?

Can I get this matter dismissed because the hearing is not warranted in the first place because I didn't have a large enough increase in income?

If the driver's license used to file a divorce petition contains false and incorrect information is it a reason for dismissal of the action?

It does not match the residency statements on the suit and is not accurate in the residency facts.

Question:

The domestic violence charges against me were dropped. Why was nothing done to my ex (at the time STBX ) for her false domestic violence charge?

Answer:

I cannot answer your question specifically to the laws of Ohio as I am not licensed in that State. Just because someone does not pursue a case or even loses at trial does not mean that the allegations were or were not true. The court cannot make the assumption that because the matter was dropped that the charges were necessarily lies. People dismiss cases everyday for various reason. Often they may not be able to locate an important witness, they may not be able to secure time off of work, or any of a thousand other reasons. If you expended attorney fees in defending the action, many jurisdictions will allow you to ask for your fees when the matter is dropped.
