What is a Counterclaim for Divorce? I am planning on filling a counterclaim in my divorce proceedings.

Answer:

First, I am not licensed to practice law in Texas. Generally, a counter-claim will be your response to the original petition for divorce. For example, your spouse may have stated that she wanted custody in her petition for divorce. Your counter-claim may state that you want custody. Not all states require that you file a counter-claim; however, you will usually have the option to do so. Please contact an attorney in your area to determine the benefits of filing in your state.
