St. Louis divorce lawyerQuestion:

My ex-wife is moving to another state with our children, and we would like to move jurisdiction of our divorce and child custody case to that state since neither of us live in the state where we were divorced.

She is the custodial parent though we technically have joint child custody.

How can I move our case to another state, and what would be the approximate cost of doing so?

Under what grounds can a parent move minor children after a divorce?

Most, if not all, states require that individuals subject to a parenting time or visitation order must file and serve upon the other party a notice of intent to relocate whenever he/she relocates his/her residence.

What state has jurisdiction of a child custody case if I want to prevent my child from being relocated out of state?

My child and my ex-wife still live in the state we were divorced in, though I have since moved across the border to another state. My ex-wife recently informed me that she is moving with our child across the country.

I need to know which state is considered the child's "home state" so that I can file a motion to prevent the move that could possibly result in a child custody modification.

advice on divorceQuestion:

My wife and I live in different states after she moved away with our children without my consent. She said she did it to avoid a divorce and I can't file if we live in different states. Is this true?

I'm confused by jurisdiction and where to file for divorce since neither of us live in the state we were married in, and we both have lived in our new states for only a short amount of time. So where do I file for divorce?

Also, since we are still married, would her actions constitute kidnapping? At the very least, how will they help me in my child custody battle?

My ex-wife has primary child custody and she told me she is going to take our child and move out of state next week.

She told me since she is the custodial parent and I have limited visitation rights that there is nothing I can do about it.

Can she move my child out of state or is she in violation of the court's child custody order?
