St. Louis divorce lawyerQuestion:

I wanted to see what the steps are to have my alimony and child support modified.

My alimony and child support payments were based off high income I accumulated during years that my income was 100% commission. I am no longer in that position and my salary has decreased substantially, though it is much more stable.

I would like to have my alimony and child support modified to reflect my new salary level. Is this possible?

oklahoma city divorce lawyerQuestion:

I have been paying child support for my oldest son who reached the age of emancipation three years ago because the child support modification papers were never filed with the court.

Now my youngest child has reached the age of majority as well, and I want to ensure these child support payments stop.

Can child support be modified retroactively to when my oldest child reached the age of emancipation?

Texas divorce lawyerQuestion:

I was unable to attend the temporary hearing where my wife and her divorce lawyer misrepresented my financial information for alimony and child support.

As a result, my temporary orders for alimony and child support payments are 75% of my monthly net income.

Can I appeal this decision and modify the temporary orders?

St. Louis divorce lawyerQuestion:

My state's child support laws are requiring me to help pay for my child's college tuition.

Many years ago, my wife's parents set up investment accounts for our child with the general understanding that this money was to pay for a college education, though it was never put in writing.

My soon-to-be-ex feels that since the money originated from her side of the family it is only to be used to help defray her cost of paying for our child's college. I think the money should be used for its intended purpose and then my wife and I would split any extra costs.

Do child support laws state that if the child has assets in her name that those assets should be consumed first before the remaining costs are split by the parents?

Texas divorce lawyerQuestion:

Do child support laws allow me to appeal a child support ruling?

My ex-wife is the custodial parent and I pay child support to her, but the children have been living with me almost exclusively since she became ill.

Because of this new arrangement tried to have modify child support or have it completely terminated since I am essentially the custodial parent now. However, the judge refused to even lower the support on the chance my ex-wife regains her health and we revert back to the original child custody agreement.

Do I have any recourse to appeal the judge's ruling? I'm paying child support yet the children live with me!
