mens divorce lawyerQuestion:

My daughter currently resides with me full-time and is no longer attending school, yet I am still paying child support to her mother - the supposed custodial parent.

Does a child have to be enrolled in school and living with the custodial parent in order for my ex-wife to continue collecting child support?

I feel that I should no longer be paying if she is leaving with me and not in school.

St. Louis divorce lawyerQuestion:

I filed a modification of child support request through the child support agency several months ago and have yet to receive a response.

Because of my substantial drop in income, thus prompting the modification, I am quickly running out of money to survive and need to have this modified calculation put in place.

What can I do to speed up the child support modification process so I don't go completely broke while waiting?

Indiana Divorce LawyerQuestion:

Do child support laws allow modifications to be made retroactive?

About 6 months ago, I sustained a 20% salary reduction, but I did not file a petition to modify child support until recently.

If the judge grants the decrease in child support, would it be made retroactive to the time my salary decreased or to when the child support modification was actually filed?

Question:Colorado Divorce Attorney

I pay child support for my son who is now receiving benefits from the state because of my permanent disability. He was awarded more in benefits than what my monthly child support payments are.

Can my son's benefits he is receiving because of my disability be allocated on my behalf as my monthly obligation for child support?

oklahoma city divorce lawyerQuestion:

How is child support calculated when the custodial parent receives a large share of marital property?

My ex received half of my retirement account in cash and is spending like crazy. With the income from her job and the money she took from my retirement, she made significantly more than I did last year.

Can I temporarily modify child support because of this even though the property division payout was a one-time payment?
