St. Louis divorce lawyerQuestion:

My child custody question is about at what age can a child choose where to live?

My ex-wife and I have joint legal and physical custody. However, our daughter has been living with her aunt for the past several years because her behavior was out of control when living with us.

My ex now wants her to come back and live with her, but my daughter is thriving in her new environment and doesn't want to move back home.

My question is at what age does my daughter have the right to decide where she wants to live?

mens divorce lawyerQuestion:

I have a jurisdiction question about where to file for divorce if I am active duty military stationed overseas.

My wife cheated on me while we were on base so I want to file in a state that has grounds for adultery because I don't think she should be able to get half of my retirement and other favorable results as a result of her infidelity.

I enlisted in one state, I've lived in another state, and my children were born in another state so I've never really had a "home state."

Where should I file? If I file for divorce first does that bind her to that state or can she file in another state?

advice on divorceQuestion:

Do child custody laws allow for the child to make a custody determination?

My ex-wife is the custodial parent of our daughter who has repeatedly said she wants to permanently live with me.

Do I need to wait until she is a certain age in order to modify child custody?

oklahoma city divorce lawyerQuestion:

Do child custody laws allow for a teenager to change custody agreements?

My ex-wife has had custody of our 16-year-old daughter for many years. Recently, my daughter has said she wants to come live with me partially because my ex-wife and her husband constantly say negative things about me.

To modify custody based on a 16-year-old's wishes, is it as simple as going to court and my daughter saying she would prefer to live with me, or do I have to prove that the environment in my house is better for her than having her mind poisoned against me in her mother's house?

Question: My 16-year-old daughter no longer wants to visit with her father. Can she just tell him she does not want to come back, and do that with no recourse? We share joint legal and physical custody. My daughter will be 17 in 30 days; will that change anything?
