St. Louis divorce lawyerQuestion:

I owned a small business during our marriage and put my wife on as co-owner merely out of respect and not as an indication of the work she provided. The business failed and now we are heavily in debt.

She wants me to take full ownership of the debt, but I cannot realistically accomplish that with the amount owed.

How will the judge divide the business debt?

dividing property divorceQuestion:

I am going through a divorce and want to know the repercussions of starting a small business before my divorce is finalized.

Because of divorce waiting periods, my divorce won't be final for almost a year and I would like to start my business as soon as possible.

How are assets and/or debts accumulated during the separation period but before the divorce is finalized handled? Can my estranged wife claim half of my business if it is launched before we are officially divorced?

divorce lawyer Daniel ExnerQuestion:

I own 25% of my family business. It is written into the company bylaws that no spouse in the instance of divorce will have any interest in the company.

Can my ex-wife still be awarded a portion of the business? Do state divorce laws overrule the company bylaws?

advice on divorceQuestion:

Since the time my child support payments were calculated, I have lost my small business, most of my income, and my ex-wife has gotten a job, which she didn't have at the time of the divorce.

I am now being threatened with jail time because I can no longer afford paying child support.

Can I get child support modified given my drop in income and the fact that my ex-wife is now working?

advice on divorceQuestion:

My divorce question is about the determination of alimony when someone is nearing retirement.

I sold my small business a few months ago that resulted in a much larger than average income for this past year. I'm intending to retire off of that sale.

My income going forward will likely be minimal, so how is alimony determined given that I am about to retire off profits I made through my business?
