Question:

A friend recently pointed out to me that my ex has a profile on myspace.com and upon further investigation I am less then happy about what is on it. My ex goes on about how she likes drink and swear and how proud she is that she gets called a tease at least once a week. She has a picture of our son posted in her profile which I am horribly upset about and is also posting pictures of herself in her undergarments. She is claiming to be too ill to work but has posted a comment volunteering to paint a guy's new house because she has so much free time. Theses are just a few of the details I have discovered on her profile and I am very concerned for the environment my son is in and how he is being cared for. I would very much like to bring this information to the attention of the courts, would they take it into consideration and how could I proceed?

As far as the Court goes, they will consider her conduct, if they find that it is not in the child's best interests to be with her. Is there a maintenance/alimony order in place? If so then you could also use this information to attack her ability to work. It is difficult to say how this will impact your case as this area, the Judge has a lot of discretion.

Question:

I had an affair which resulted in a pregnancy. I want to know what the chances of me obtaining custody are in the state of Maine. She is an atrocious housekeeper who I have been tempted to call DHHS on multiple time due to the mess. She has also gone to work at nite and left her other kids (10, 8) at home by themselves for the evening. She spends all her free time in bed sleeping such that her other kids complain about it. Their diet is predominantly fast food. I have serious concerns about a child of mine being raised in this environment. Any suggestions?

The care of the children is very important. That is one of the factors that the court will look at. Also how much time have you been spending with the child? Also have you been involved in the decision making? That is also key.

Question:

My wife is from Bahamas and we have a 8 year old son and she has threatned to take son away to the Bahamas. How does that work with custody of my son and the posssiblity of him moving to the Bahamas? My wife has has mental issues and was prescribe with medication for emotional issues. Can that factor in to custody and can that be used.

Generally she can not take your son out of the country without your consent. Once your case is filed (for divorce), then the court will not allow her to move him out of the country during the case. She will have to prove it is in his best interest.
