divorce decree issuesBy Nathan A. Hacker

Indianapolis Divorce Lawyer

After your divorce decree has been finalized and entered by the court, you should seek counsel regarding any trusts or estates that you have set up for your family.

You will want to have those rewritten so that your children are the beneficiaries of your hard work.

If you have a life insurance policy that lists your ex-wife as the beneficiary you may want to consider having that transferred into a trust for your children.

divorce attorney Jill DuffyQuestion:

My wife and I are separated but not divorced yet. To earn a living, I am considering starting a business.

Would my wife have a claim to any of the assets from my business if we are technically not divorced yet?

If so, is there any way to protect those assets before we are officially divorced?

Divorce attorney Jason BowmanQuestion:

How is child support calculated when income is derived entirely from dividends and capital gains rather than "earned income" from a job?

What happens if some of one's income-producing assets are subsequently liquidated for the purpose of buying a house? Is projected income then reduced?

Question:

My husband and I are separated. He just received a big worker's comp check. Is there any way I can garnish it to get half to pay debts that I need help with due to his abandoning me?

Answer:

Allow me to preface my response with the disclaimer that I am not licensed in the State of Maryland. You can not garnish because you do not have a Judgment against him. But some or all of that award may be marital money, so if you file for divorce, the Court may divide it or at least freeze the account until it is divided.
