New Jersey divorce lawyerQuestion:

My soon-to-be ex-wife is a stay-at-home mom and has been since our marriage almost 20 years ago. She wants me to fund her tuition at a local community college in order for her to return to the workforce in addition to paying her alimony.

Are there any legal parameters or customary judgments surrounding the ex-husband's support of tuition costs above and beyond the already calculated and agreed upon alimony payment?

New Jersey divorce lawyerQuestion:

I continue to live in the state where my divorce took place and pay child support according to that state's child support laws.

My child and his mother live in another state where my payments are sent. According to that state's laws, my child would be considered emancipated because it has a lower age of majority.

Will I have to continue to pay under the child support emancipation laws of the state I reside in or should he be considered emancipated under the laws of the state where he now lives?

post nuptial agreementBy Sara Pitcher

Mens Divorce Lawyer

Though pre-nuptial agreements tend to receive the majority of attention and are often encouraged by divorce attorneys, there is a lesser-known option that also serves as a protective marriage contract: a post nuptial agreement.

A post nuptial agreement proves it is never too late to define and protect your assets even if you did not have the foresight to execute an agreement before the marriage.

alimony recapture ruleBy Jennifer M. Paine

Cordell & Cordell Divorce Lawyer

My previous article "What Is The Alimony Recapture Rule?" discussed the three-year alimony tax trap known as the recapture rule.

This rule forces the alimony payer to report as income the alimony payments he previously deducted, which means the payee spouse is entitled to reduce from income the alimony payments previously received.

So how do you avoid the recapture rule and the subsequent tax nightmare? Discuss these five tips with your attorney and your CPA:

georgia divorce lawyerQuestion:

Can I reduce my payments through a child support modification given that I am responsible for paying my children's transportation expenses?

Since my ex-wife and I live far away from each other, in order to exercise my court-ordered visitation I have to pay the cost to fly my children to see me. Obviously, this gets very expensive.

Can I modify child support based on those extra expenses I have to incur?
