The holidays are filled with so many wonderful things: family, friends, parties, religious endeavors, and, of course, gifts.

All of these things can bring us joy (along with the requisite stress), but it is the gifts that often create the greatest source of concern, especially if you have to worry about what people around you are going to be purchasing for your daughter.

Very often, people buy things that are meaningful to them, and not as meaningful to the receiver. Additionally, not everyone will respect your desire to promote your daughter's empowerment.

Situations involving gifts do pose a unique challenge. People in your life may not have the level of awareness you do, nor will they share your concerns or have the same values about what will promote a positive sense of self and confidence in your daughter.

Question:

Even though I owe back child support, which I intend on paying, my child has turned 18. The support office is still taking out the same amount as before, This included 50 dollars on current child support and 25 dollars on past due. I've been paying this for a few years now, but since my child has turned 18 shouldn't all of it show toward the past due amount. My ex has hidden from me for some years now, so I have no way of finding out where they are, or if they are going to go to college, or even if they are in college. I work out of state so it's hard for me to find out anything from our local child support offices. Are they responsible for finding out if my child has continued school and if so are they responsible for letting me know? I have seen no changes in my support payments.

Answer:

I cannot answer your question specifically to the laws of Tennessee as I am not licensed to practice law in that State. Some jurisdictions require the parents to be proactive and inform the agency as to the child's status. I would assume that is true in your state since your support has continued. I suggest you contact the agency and ask them to send you the paperwork to file a request to terminate current support. They should be able to inform you of the procedure beyond that point.

Question:

My son was employed for 13 months was not enrolled in college and was 18 years old. I had been paying child support during this time. I want to reclaim the overpayment. The judge told be that I had to formally emancipate him through the court. My divorce papers state that if he is employed and not in school he is emancipated. Are the terms in the divorce papers conditions, and if met are legally binding or did I really have to have him emancipated. He is now enrolled in school. I must appear on July 3 and I would like to know if I have grounds to reclaim the money even if he was not emancipated in the court system.

Answer:

Allow me to preface my answer to your question with the disclaimer that I am not licensed to practice law in the state of New York. In the jurisdiction where I practice, any overpayment prior to the Court ordering the child emancipated, is not reimbursable. You certainly can request a refund of overpayment from the Judge. The worst that will come from that is that the Judge will say he can not refund the monies.
